Terms of service
1Agreement
These terms govern your use of ShipVia, a software application operated by Andrei Antonov, an individual based in Georgia (“ShipVia”, “we”, “us”). By installing or using ShipVia, you agree to these terms. If you use ShipVia for a business, you confirm that you can accept these terms on its behalf.
2The service
ShipVia connects your Shopify store to fulfillment services such as Amazon Multi-Channel Fulfillment and, when available, Walmart Multichannel Solutions. It sends the orders you choose for fulfillment, syncs inventory levels and posts tracking information to Shopify.
ShipVia is in early access, so features may change, and some may be added or removed.
3Your accounts
- You need an active Shopify store and a seller account in good standing with each fulfillment service you connect.
- You’re responsible for following the terms and policies of Shopify, Amazon and Walmart, including their rules on product eligibility, packaging and restricted products.
- You authorize ShipVia to act on your behalf within the permissions you approve, and you can revoke that access at any time.
- Keep your account credentials secure, and tell us promptly if you suspect unauthorized access.
4Fees
- ShipVia is free during early access.
- Paid plans will be billed through Shopify. We’ll give you at least 30 days’ notice before any charge starts.
- Fulfillment, storage, shipping and other fees charged by Amazon, Walmart or Shopify are between you and them, and are your responsibility.
- Fees don’t include taxes, which you pay where applicable.
- You can cancel at any time by uninstalling ShipVia. Shopify stops the subscription, and we don’t refund a billing period that has already started unless the law requires it.
5Your responsibilities
- Keep product and SKU information accurate, and review SKU matches before orders are sent.
- Check that your routing rules send the orders you intend.
- Monitor your orders and inventory in Shopify and in your seller accounts.
- Make sure you have the right to share your customers’ information with fulfillment services, including by telling customers about it in your own privacy notice.
6Acceptable use
You agree not to:
- use ShipVia for anything unlawful or to break the policies of a connected platform;
- try to access another merchant’s data or ShipVia’s systems without permission;
- copy, reverse engineer or resell ShipVia;
- interfere with the service, including by overloading it or bypassing its limits.
7Data protection
Our privacy policy explains how we handle personal information and is part of these terms. For your customers’ information, ShipVia acts as your processor: it uses that information only to provide the service on your instructions, keeps it confidential and deletes it as the privacy policy describes.
8Third-party services
ShipVia depends on services run by Shopify, Amazon and Walmart. We aren’t responsible for their availability, fees, policy changes or decisions, such as canceled fulfillment orders, lost or damaged inventory, or account restrictions. If a platform changes or restricts its API, we may need to change or remove related features.
ShipVia is independent and isn’t affiliated with, endorsed or sponsored by these companies.
9Availability and changes
We work to keep ShipVia available and reliable, but it may be interrupted for maintenance, updates or reasons outside our control. We may change or discontinue features, and we’ll give you reasonable notice of changes that materially affect how you use ShipVia.
10Disclaimer
ShipVia is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t guarantee that every order will be fulfilled, that inventory counts will always match, or that the service will be free of errors.
11Limitation of liability
To the extent the law allows, ShipVia isn’t liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or inventory. Our total liability for any claim relating to ShipVia is limited to the amount you paid for ShipVia in the 12 months before the claim, or USD 100 if you haven’t paid anything.
12Indemnity
You agree to cover claims, losses and costs arising from your products, your orders, your breach of these terms, or your breach of a connected platform’s policies.
13Suspension and termination
You can stop using ShipVia at any time by uninstalling it. We may suspend or end your access if you breach these terms, if your use creates a security risk, or if a connected platform requires it. When access ends, we delete your information as the privacy policy describes.
14Governing law
These terms are governed by the laws of Georgia. Disputes will be resolved by the courts of Tbilisi, unless mandatory law where you are based gives you other rights.
15Changes to these terms
We’ll post updated terms on this page with a new date. If a change is significant, we’ll notify you by email or in the app at least 14 days before it takes effect. If you keep using ShipVia after that, you accept the updated terms.
